कार्यस्थल पेशेवर और सुरक्षित स्थान होते हैं जहाँ हर कर्मचारी, चाहे वह किसी भी लिंग का हो, बिना किसी डर या यौन उत्पीड़न की निरंतर बेचैनी के सम्मान के साथ अपने कर्तव्य का पालन कर सकता है। इस मुद्दे की गहन गंभीरता और व्यापक प्रकृति को पहचानते हुए, भारतीय न्यायपालिका और विधायिका ने कार्यस्थल पर महिलाओं की सुरक्षा के लिए मजबूत कानूनी तंत्र स्थापित करने के लिए महत्वपूर्ण, वृद्धिशील कदम उठाए हैं। सबसे महत्वपूर्ण और व्यापक वैधानिक सुरक्षा उपाय आंतरिक शिकायत समिति (आईसीसी) है, जिसे कार्यस्थल पर महिलाओं का यौन उत्पीड़न (रोकथाम, निषेध और निवारण) अधिनियम, 2013–जिसे व्यापक रूप से और आसानी से पॉश अधिनियम (POSH Act) के रूप में जाना जाता है, के द्वारा अनिवार्य किया गया है।

आईसीसी की उत्पत्ति और कानूनी आधार

यौन उत्पीड़न को संबोधित करने के लिए एक निर्दिष्ट कार्यस्थल तंत्र की अवधारणा एक मूलभूत न्यायिक निर्णय में गहरी जड़ें जमा चुकी है। आईसीसी (ICC) का आधार 1997 के सुप्रीम कोर्ट के फैसले विशाखा और अन्य बनाम राजस्थान राज्य से हुआ है। यह महत्वपूर्ण मामला राजस्थान में एक जमीनी स्तर की सामाजिक कार्यकर्ता भंवरी देवी के साथ हुए क्रूर सामूहिक बलात्कार से उत्पन्न हुआ था, जिन्हें उनके गांव में बाल विवाह को रोकने के उनके साहसी प्रयासों के लिए निशाना बनाया गया और पीड़ित किया गया था। सुप्रीम कोर्ट ने इस तथ्य का न्यायिक संज्ञान लिया कि कार्यस्थल पर यौन उत्पीड़न एक व्यापक वास्तविकता थी जो मौलिक रूप से भारत के संविधान के तहत गारंटीकृत एक महिला के मौलिक अधिकारों का गंभीर उल्लंघन करती थी। विशेष रूप से, अदालत ने इसे समानता के अधिकार (अनुच्छेद 14), किसी भी पेशे का अभ्यास करने के अधिकार (अनुच्छेद 19(1)(जी)), और सम्मान के साथ जीवन के अधिकार (अनुच्छेद 21) का उल्लंघन माना।

चूंकि उस समय हिंसा के इस रूप को संबोधित करने के लिए कोई विशिष्ट, समर्पित कानून मौजूद नहीं था, सुप्रीम कोर्ट ने, अपनी शक्ति का प्रयोग करते हुए, कानूनी रूप से बाध्यकारी प्रशासनिक और प्रक्रियात्मक मानदंडों का एक व्यापक सेट निर्धारित किया, जिसे ‘विशाखा दिशानिर्देश’ के रूप में जाना जाता है। इन दिशानिर्देशों ने देश भर के सभी नियोक्ताओं पर यौन उत्पीड़न के मामलों को सक्रिय रूप से रोकने, सख्ती से प्रतिबंधित करने और प्रभावी ढंग से निवारण करने का एक स्पष्ट और गैर-परक्राम्य कर्तव्य रखा। महत्वपूर्ण रूप से, दिशानिर्देशों ने अनिवार्य किया कि नियोक्ताओं को शिकायतों को प्राप्त करने और उनकी गहन जांच करने के लिए हर कार्यस्थल पर एक शिकायत समिति स्थापित करनी होगी।

वैधानिक अधिनियमन (पॉश अधिनियम, 2013)

विशाखा दिशानिर्देशों की नींव पर निर्माण करते हुए, भारतीय संसद ने सुप्रीम कोर्ट द्वारा स्थापित सिद्धांतों को पूर्ण वैधानिक बल और एक बाध्यकारी कानूनी ढांचा देने के लिए 2013 में पॉश (POSH) अधिनियम लागू किया। अधिनियम कानूनी रूप से अनिवार्य करता है कि हर कार्यस्थल, चाहे वह सरकारी, निजी, या अनौपचारिक क्षेत्र का प्रतिष्ठान हो जिसमें दस या अधिक कर्मचारी कार्यरत हों, को अनिवार्य रूप से एक आईसीसी का गठन करना होगा। आईसीसी को औपचारिक रूप से एक संगठन (संस्था/ महाविद्यालय) के भीतर स्थापित एक वैधानिक अर्ध-न्यायिक निकाय के रूप में परिभाषित किया गया है। इसका व्यापक मिशन कार्यस्थल पर यौन उत्पीड़न की शिकायतों को प्राप्त करना, उनकी जांच करना और उन पर कार्रवाई की सिफारिश करना है। इसका प्राथमिक उद्देश्य सभी महिलाओं के लिए एक सुरक्षित, संरक्षित और सम्मानजनक कामकाजी माहौल को परिश्रमपूर्वक बनाए रखना और सुनिश्चित करना है।

संस्थागत प्राधिकरण का दायित्व

नियोक्ताओं को एक औपचारिक लिखित आदेश के माध्यम से आईसीसी स्थापित करने के लिए कानूनी रूप से आवश्यक है। पॉश अधिनियम किसी भी नियोक्ता के लिए सख्त दंड और संभावित अभियोजन निर्धारित करता है जो आईसीसी का गठन करने में विफल रहता है या इसके प्रावधानों का पालन करने में विफल रहता है। अपनी शिकायत निवारण कार्य के अलावा, आईसीसी यौन उत्पीड़न क्या है, इसके बारे में जागरूकता पैदा करने, कानून के साथ संगठन के समग्र अनुपालन को सुनिश्चित करने और महिला कर्मचारियों के अधिकारों की रक्षा करने में भी महत्वपूर्ण भूमिका निभाती है।

आंतरिक शिकायत समिति का गठन और संरचना

पॉश अधिनियम इसकी निष्पक्षता और प्रभावशीलता सुनिश्चित करने के लिए आईसीसी की संरचना और गठन के संबंध में अत्यधिक विशिष्ट है। समिति में कम से कम चार सदस्य होने चाहिए। एक निष्पक्ष और सहानुभूतिपूर्ण जांच प्रक्रिया सुनिश्चित करने के लिए एक महत्वपूर्ण आवश्यकता यह है कि कुल सदस्यों में से कम से कम आधे (50%) महिलायें होनी चाहिए।

आवश्यक सदस्य:

1. पीठासीन अधिकारी (अध्यक्ष)

  • आवश्यकता: संगठन के भीतर एक वरिष्ठ स्तर पर कार्यरत एक महिला होनी चाहिए।
  • तर्क: वरिष्ठता की आवश्यकता कई उद्देश्यों को पूरा करती है |

  • आकस्मिकता: यदि प्राथमिक कार्यस्थल पर एक उपयुक्त वरिष्ठ महिला कर्मचारी उपलब्ध नहीं है, तो नियोक्ता को उसी संगठन की किसी अन्य प्रशासनिक इकाई, कार्यालय या शाखा से एक महिला को नामित करने की अनुमति है।

2. दो कर्मचारी सदस्य

  • आवश्यकता: इन सदस्यों का चयन संगठन/ संस्था/ महाविद्यालय के भीतर काम करने वाले कर्मचारियों में से किया जाना चाहिए।
  • चयन वरीयता: चयन में उन कर्मचारियों को वरीयता दी जाती है जो महिला अधिकारों और सशक्तिकरण के उद्देश्य के प्रति प्रतिबद्धता प्रदर्शित कर सकते हैं, या जिनके पास यौन उत्पीड़न की रोकथाम और निवारण से संबंधित प्रासंगिक कानूनी ज्ञान या पूर्व सामाजिक कार्य अनुभव है। यह विशेषज्ञता मुद्दों की सूक्ष्म समझ के लिए महत्वपूर्ण है।

3. एक बाहरी सदस्य

  • आवश्यकता: यह किसी स्थापित गैर सरकारी संगठन (एनजीओ) या विशेष रूप से महिला अधिकारों के उद्देश्य के लिए प्रतिबद्ध संघ का व्यक्ति होना चाहिए, या एक ऐसा व्यक्ति जो अन्यथा यौन उत्पीड़न से संबंधित मुद्दों से अच्छी तरह से परिचित हो।

ENSURING A SAFE WORKPLACE

The Internal Complaints Committee (ICC)

Workplaces are meant to be professional and safe spaces where every employee, irrespective of their gender, can perform their duties with dignity, without the constant fear or discomfort of sexual harassment. Recognising the profound gravity and widespread nature of this issue, the Indian judiciary and legislature have taken crucial, incremental steps to establish robust legal mechanisms for the protection of women at work. The most pivotal and comprehensive statutory safeguard put in place is the Internal Complaints Committee (ICC), which is mandated by the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013–widely and conveniently known as the POSH Act.

Origin and Legal Foundation of the ICC

The concept of a designated workplace mechanism to address sexual harassment is deeply rooted in a foundational judicial ruling. The genesis of the ICC can be traced back to the landmark 1997 Supreme Court judgment in Vishaka & Ors. v. State of Rajasthan. This pivotal case arose from the brutal gang rape of Bhanwari Devi, a grassroots social worker in Rajasthan who was targeted and victimised for her courageous attempts to prevent child marriage in her village. The Supreme Court took judicial notice of the fact that sexual harassment in the workplace was a pervasive reality that fundamentally constituted a grave violation of a woman’s fundamental rights guaranteed under the Constitution of India. Specifically, the court recognised it as a violation of the right to equality (Article 14), the right to practice any profession (Article 19(1)(g), and the right to life with dignity (Article 21).

Since no specific, dedicated legislation existed at that time to address this form of violence, the Supreme Court, in the exercise of its power, laid down a comprehensive set of legally binding administrative and procedural norms, known as the “Vishaka Guidelines.” These guidelines placed a clear and non-negotiable duty upon all employers across the country to actively prevent, strictly prohibit, and effectively redress instances of sexual harassment. Crucially, the guidelines mandated that employers must establish a Complaints Committee at every workplace to receive and thoroughly investigate complaints.

Statutory Enactment (The POSH Act, 2013)

Building upon the foundation of the Vishaka Guidelines, the Indian Parliament enacted the POSH Act in 2013 to give full statutory force and a binding legal framework to the principles established by the Supreme Court. The Act legally mandates that every workplace, be it a government, private, or informal sector establishment that employs ten or more employees must compulsorily constitute an ICC. The ICC is formally defined as a statutory quasi-judicial body established within an organisation (institution/ degree college). Its overarching mission is to receive, inquire into, and recommend action on complaints of sexual harassment at the workplace. Its primary objective is to diligently uphold and ensure a safe, secure, and dignified working environment for all women.

Obligation of Institutional Authority

Employers are legally required to set up the ICC through a formal written order. The POSH Act prescribes strict penalties and potential prosecution for any employer who fails to constitute the ICC or fails to comply with its provisions. Beyond its complaint redressal function, the ICC also plays a crucial role in creating awareness about what constitutes sexual harassment, ensuring the overall compliance of organization with the law, and safeguarding the rights of women employees.

Constitution and Composition of the Internal Complaints Committee

The POSH Act is highly specific regarding the structure and formation of the ICC to ensure its impartiality and effectiveness. The committee must have a minimum of four members. A critical requirement to ensure a fair and empathetic investigation process is the mandate that at least half (50%) of the total members must be women.

Required Members:

1. Presiding Officer (Chairperson)

  • Requirement: Must be a woman employed at a senior level within the organisation.
  • Rationale: The requirement for seniority serves multiple purposes:
  • It helps ensure the complainant feels comfortable and confident in reporting the issue to a position of authority.
  • It is assumed that a senior employee will possess the necessary maturity and leadership skills to maintain the objectivity and impartiality essential for the committee's functioning.
  • Contingency: If a suitable senior woman employee is not available at the primary workplace, the employer is permitted to nominate a woman from another administrative unit, office, or branch of the same organisation.

2.Two Employee Members

  • Requirement: These members must be selected from the employees working within the organisation.
  • Selection Preference: Preference in selection is given to employees who can demonstrate a commitment to the cause of women’s rights and empowerment, or those who possess relevant legal knowledge or prior social work experience related to the prevention and redressal of sexual harassment. This expertise is vital for a nuanced understanding of the issues.

3. One External Member

  • Requirement: This must be a person from an established Non-Governmental Organisation (NGO) or an association specifically committed to the cause of women’s rights, or a person who is otherwise well-familiar with the issues relating to sexual harassment.
  • Rationale: The inclusion of an External Member is a deliberate measure to enhance the credibility and fairness of the ICC. This member brings essential independence to the proceedings of ICC, helping to mitigate the risk of institutional bias, internal politics, or pressure from the employer during the investigation.

Key Points About Composition and Tenure:

  • Formal Appointment: All members of the ICC must be appointed by the employer through a formal, documented written order.
  • Term of Office: The tenure for all ICC members is specifically limited by the Act to a maximum of three years from the date of their appointment.
